Equal Educational Opportunities JAA Equal Educational Opportunities (Cf. GAAA) JAA It is the policy of the board to offer an educational program which attempts to meet the needs of all the students of the district to the fullest possible extent. All school personnel will be encouraged to utilize the suggestions of students in every way possible in the development and formulation of policies, rules, and regulations which are directly related to student concerns. All administrators and teachers, in developing curriculum and activity program recommendations for the consideration of the board, shall give high priority to the meeting of individual student needs. In order to comply with the minimum standards set forth in the regulations, 34 code of Federal Regulations Part 223, governing local educational agencies claiming "children residing on Indian lands" for assistance under Title VIII of Public Law 103-382, section 8003, the district will comply with the following procedures: I. Within the first 30 school days of each new school year, the superintendent or a designate will provide in writing to the parents of children residing on Indian lands and the chairperson of the Potawatomi Tribal council the following information: A. Notice of the dates, place, and time of regular meetings of the board along with an invitation to attend or send representatives to each of the meetings for the purpose of observing and speaking on behalf of those children residing on Indian lands. B. A list of the names of the members of the Impact-Aid Review Task Force.II. Each school year the board will establish an Impact Aid Review Task Force consisting of the Title IX Indian Education director, representative(s) from the Title IX Indian Education Parent Committee, one elementary principal, one secondary principal, one elementary counselor, one secondary counselor, the superintendent or a designate, the Johnson O'Malley Coordinator, representative(s) from the JOM Parent Committee, the Tribal Indian Education Director, and the tribal chairperson or a designate. This task force will be responsible for gathering and reviewing selected school data concerning the extent to which Indian children participate on an equal basis in the educational program and for preparing a modified program, when necessary, to allow Indian children to participate on an equal basis.III. No later than March 31 of each school year, the superintendent or a designate will mail to the parents of children residing on Indian lands and the chairperson of the Potawatomi Tribal Council written notice that the Impact Aid application has been filed with the Department of Education. This notice will include a summary of (1) the number of students affected, (2) an evaluation of education programs assisted with Impact Aid funds, (3) program plans for education programs the LEA plans to initiate/eliminate, if any, and (4) a statement that a complete copy of the application document and program evaluations/plans will be mailed to individuals upon request. Also included will be notice of the date, time, and place of a special Board of Education meeting which will be held for the purpose of meeting with Indian parents and tribal officials. Prior to this public hearing, parents qualifying the district for Impact Aid will receive: A. A copy of the education policy JAA and JAA-R concerning equal educational opportunities. B. Notice that the district is the recipient of Title VIII (Impact Aid) funds and that the board intends to file an application for Impact Aid funds based on the number of children residing on Indian lands. This notice will inform parents and the tribe that: 1. They are welcome to present their views regarding the application. 2. They may make recommendations concerning the needs of their children and the ways by which they can assist their children in realizing the benefits to be derived from the education program of the district. 3. The board and/or administration are willing to meet and confer, upon request, with representatives of Indian parents in regard to the planning and development of the local educational program.JAA-R Equal Educational Opportunities (Cf.GAAA) JAA-R-24. They are welcome to present their overall views on the educational program and its operation, and the degree of parental participation allowed. C. Notice that the tribe, or its designated agent, may file a written complaint With the Assistant Secretary, Elementary and Secondary Education, Department of matters in CFR Part 223.JAA-R Equal Educational Opportunities (Cf.GAAA) JAA-R-3IV. No later than April 30 of each school year, a special meeting will be held by the Board of Education for the purpose of meeting with Indian parents and tribal officials and considering the participation of Indian children on an equal basis in the education program. School data gathered by the Impact Aid Review task force and recommendations prepared by the task force for a modified program, when necessary, will be presented. Comments and input from parents and tribal officials about the Impact Aid application, program plans and evaluations will be received. Tribal officials will be given the opportunity to present their views regarding the planning and development of the educational program. They may make recommendations concerning the needs of their children and their ability to assist their children's education, and present their views regarding the needs of their children, the LEA's educational program and the parental participation allowed. This special meeting will be held in accordance with the laws of the State of Kansas. The location and time will be published in the Board of Education's designated official newspaper. V. Following the special Board of Education meeting with Indian parents and tribal officials, the Impact Aid Review task force will review the Indian input and opportunity for input and the LEA's response to the Indian comments recommending changes in the LEA's policies and procedures, and recommend modification of the policies and procedures, if necessary, to respond to the Indian input. Final recommendations will be prepared and considered at a regular Board of Education meeting. Approved: April 12, 2004
